Wallin And Klarich Attorney Convinces Judge To Reduce Sentence From Possible 50 Years In Prison To One Year In County Jail
Client facing life in prison gets 6 month sentence in Jail and two strike removed thanks to his Wallin & Klarich attorney.
Wallin and Klarich associate Daniel S. Moffatt had an Orange County Superior Court judge grant his motion under California Three Strikes Law, to “strike” the prior strike convictions of a very fortunate Wallin and Klarich client on November 7, 2012. This decision allowed the judge to place our client on probation on the condition he serves one year in county jail.
Our client had two prior strike convictions for having sex with a minor when he was 18 years old. This occurred over twenty years ago. Our client was now facing felony charges for domestic violence as well as failing to register as a sex offender. Since both of the new charges were felonies he was facing a possible sentence of 25 years to life on both charges or a total possible sentence of 50 years to life.
After months of negotiating, Attorney Daniel Moffatt was able to convince the prosecutor to agree to offer a sentence of seven years and four months in prison for our client. Most criminal defense attorneys would have recommended that the accused accept this offer because of the “risk” of the defendant being sentenced to 50 years to life in prison. However, Wallin and Klarich attorneys never give up.
On November 7, 2012 Daniel Moffatt, an experienced criminal defense attorney with Wallin and Klarich was able to have the court grant his legal motions to “strike” our clients “strikes” for the purpose of sentencing. The judge then imposed a six month jail sentence on both charges. The defendant will then be placed on probation for two additional years after completing his sentence. In effect our client will only serve half of his one year sentence, meaning instead of a possible 50 years to life sentence he will only do six months in custody and then be a free man.
People often ask why they should hire Wallin and Klarich when facing a serious criminal charge. This case clearly answers that question. Wallin and Klarich will not stop fighting for our clients no matter what it takes.
