STL Traffic Law & DWI Counselors Celebrates Two Wins on DWI Admin Hearings
PR Log - Mar 27, 2012 - St. Charles, MO March 27, 2012--Traffic Law Counselors, a subsidiary of Carter Law Offices LLC, today is celebrating its mounting successes in DWI cases. In less than a week, Traffic Law Counselors has won two DWI administrative license hearings.
"Administrative hearings are particularly difficult to win," said an attorney with the firm. "Unlike the more well-known criminal charges, administrative hearings deal solely with the license loss that often comes along with a DWI charge. These hard-to-win hearings don’t involve the 'beyond a reasonable doubt' standard and are conducted not by a judge, but by a hearing officer acting as both prosecutor and judge. This set-up is troubling and most people are very surprised at how the system works.”
Despite these difficulties, Traffic Law Counselors experienced an outright win today when they prevented a client from losing his license because of the municipality's failure to properly maintain their breathalyzer equipment. This comes on the heels of a similar win in St. Louis County last week wherein a commissioner erroneously excluded an officer’s relevant and contradictory prior testimony.
"It's easy for officers to accuse someone of being under the influence and many people who are faced with these charges give up rather than fighting them at the administrative level, believing they have no chance to win. These recent victories may seem insignificant to some, but to the wrongly accused facing the loss of a license, these wins are a very big deal when faced with taxi-cab rides and leaning on friends/family.
St. Louis' Traffic Law Counselors procures excellent results in a variety of cases: speeding tickets, Driving While Suspended matters, DWIs, minor in possession of alcohol and drug possession. Treating every client's matter as if it were our own.
